During the public comment session at the last City Council meeting, you inquired about the residential status of the mayor and handed the city attorney a document referencing your comment. As you know, there is no dialogue between citizens, staff, or elected officials during the "comment" period. Even though the city attorney reports to the elected officials, city manager, and senior staff, it appears that there is an expectation for a response from the city attorney. In honoring that expectation, he has done a legal review of this inquiry and has concluded the following based on his investigation and research:

Re: Elected Official Renting Residence from Another Elected Official

At the August 5, 2025, City Council meeting during Public Comment, Renee Prince alleged that two city officials have the same address and stated that it creates a conflict of interest. She then presented me with documents that show Camille Lowe resides at 1010 Nestopia Way and that Tom Reed resides at 1010 B Nestopia Way. I spoke with both Tom (on August 6, 2025) and Camille (on August 12, 2025) separately. Both confirmed that Tom rents a studio apartment at Camille's house, that there is a written lease, and that Tom pays Camille rent.


Following my investigation, I researched the state law found at O.C.G.A. § 45-10-1 and O.C.G.A. §$ 45-10-20 to 40-10-29 to determine if this arrangement presents either a conflict of interest or constitutes an ethics violation. It does not. Similarly, it does not violate the city's charter or any ordinance.

The city attorney has addressed the legality of the current residential agreement in place by these two parties. Ingress and egress to this residential dwelling and accessory dwelling unit nor postal identifiers have no effect on the current arrangements in place

I have a question: It seems like the studio apartment (a room) has its own number (1010 B). Did Councilman Lowe have to do anything within the city or post office to legally change this?

Does it have its own entrance? With this being a studio apartment, does it have its own entrance, or does it share the entrance with 1010 A?
