Violations

WHEREAS, the Investigations determined the Respondent failed to properly design, install, and maintain BMPs in compliance with Part III.D.3 and IV of the Permit, which resulted in sediment leaving the Site; and

WHEREAS, the Respondent failed to obtain a warm water stream buffer variance, from the Division, prior to performing land disturbing activities within the State's mandated 25-foot buffer as required by Part IV.(i) of the Permit; and

WHEREAS, the Investigations determined that the Respondent failed to conduct the

required inspections and reports compliant with Part IV.D.4 of the Permit; and

WHEREAS, the investigations determined the Respondent disturbed additional acreage beyond the limits of disturbance in accordance with the ESPCP and failed to pay additional fees associated with the construction activity; and
