Good evening, Mayor, City Council Leaders and Citizens:

Ethics rules address conflicts of interest related to both direct and indirect financial interest. Municipalities with comprehensive ethics policies typically address what is meant by an indirect financial interest. Examples include ownership through various types of legal entities, relatives, or other arrangements or devices where the beneficiary could benefit from indirect ownership.

To some it might seem that just following the letter of the law would support an assertion that they do not have, or ever had, a financial interest in a particular developer or subdivision.

But what if a mayor owned 17 properties in a hamlet and that such investment was a substantial portion of his personal net worth as well a meaningful percentage of properties in that hamlet? And, what if the profit on the resale of these properties is likely several millions of dollars. This profit incentive would certainly suggest a personal financial interest.

Some voters might think that several millions of dollars would affect someone's judgment on zoning, permitting, and wastewater enforcement in that hamlet.

They might even go so far as to conclude that this financial arrangement constitutes a conflict of interest.

But hold-on, my open records effort yields yet another interesting tidbit.

It just so happens that the registered agent for the mayor's limited liability corporations is none other than Rick Lindsey, the same city attorney who insists "there is no conflict of interest"
